NavaMaa Health and Wellness Private Limited (also referred to as "NavaMaa", Company, we, our, us) values your privacy and is committed to ensuring that your privacy is protected. The purpose of this "Privacy Policy" is to describe what information we collect about you, why we collect it, how we use your information, how we protect and share your information, the choices we offer you, including your ability to access and update information about yourself ("User" or "your" or "you") in the course of your use of the Website.
This Privacy Policy must be read in conjunction with the "Terms of Use" and all the terms and conditions therein. By visiting our website, signing up or logging into the website, uploading information on our website; you acknowledge and unconditionally accept the policy. If you do not agree with this Privacy Policy and our "Terms of Use", do not use our website and services or provide here any of your personal data.
All terms capitalized herein but not defined shall have the same meaning ascribed to them in the Terms of Use.

1. Applicability

We may collect your information in the following ways:

This Privacy Policy shall apply to all information listed above including but not limited to any information that you may submit or upload on the Website or on our social media handles, e-mails that you exchange with us and other users of the Website, Services, or any online/mobile application or service that refers or links to this Privacy Policy. The Privacy Policy does not apply to, nor do we take any responsibility for, any information that is collected by any third party either using the Website or through any links provided on the Website or through any advertisements featured on the Website.

2. Information We Collect

We collect the following broad categories of information from you (collectively referred to as "Information"):

•  "Personally Identifiable Information" – information that could be used to identify you such as, your name, email address, age, gender, documents, scanned reports, medical history, health and wellness related information, prescriptions, internet protocol (IP) addresses and other similar information;

•  "Sensitive Personal Information" – such as passwords, health information, medical history and payment related information;

•  "Non-Personal Information" – information that cannot be used to identify you such as the webpages that you have viewed and your usage patterns, including certain types of device information.

Below is an inclusive list of information that we collect from you in connection with your access and use of the Website:

Information that we need you to provide to enable you to sign-up for the use of the Website provided by the Company.

Account Information: When you sign-up for an account on the Website ("User Account"), we require certain information such as your name, phone number, and email address for the purpose of user registration, identification, and account verification.

Medical Information: If you use the Website to book appointments to consult RMP or other experts, you will be providing us and the respective RPM or other expert listed on the website with the relevant information pertaining to your health conditions and well-being and other medical or health information.

Payment Transaction Information: We may collect your first name, last name, phone number, and billing address, when you register for availing the services offered on the Website. Your payment details are collected through a third-party gateway to which you will be required to provide requisite information separately in order to process your payments.

Information we automatically collect from your use of the Website: When you use the Website, we automatically collect information about the functionalities you use on the Website and how you use them. This information is necessary for the effective performance of the contract between you and us, to enable us to comply with legal obligations given our legitimate interest in being able to provide and improve the functionalities relating to the Website and the Services.

Geo-location Information: When you use certain features of the Website, we may collect information about your location such as your IP address, which in turn would enable us to infer your city, region/state, country, continent, internet service provider (ISP), longitude/latitude coordinates of location, type of connection (like residential, business, etc.), and name of the organization that owns the connection (i.e. if it is a business connection or not).

Usage Information: We collect information about your interactions with the Website such as the pages viewed on the Website and the User Account dashboard, content created or uploaded through use of the Website and Services.

Log File and Device Information: When you use the Website, we automatically collect and store certain information in server logs. This includes details of how you used the Website, such as access to your User Account, certain information that your web browser sends whenever you visit the Website, internet protocol address, information inferred from your internet protocol address like location, ISP details, device information such as hardware configuration and operating system, browser types, referring / exit pages and URL's, number of clicks, domain names, landing pages, pages viewed and other such information. We do not link this automatically collected data to Personally Identifiable Information.

Cookies and Tracking Technologies: We collect device specific information (such as your hardware model, operating system version, unique device identifiers). We may also associate your device identifiers with your User Account. You may decline these cookies by changing your browser settings, if permitted. However, do note that this may impact certain features of the Website or your experience in using the Website.

Information we collect from third parties: We may work with a limited number of third parties (including mobile network providers, and delivery service providers, collection agencies, analytics providers) to provide the Services and may receive information about you from such third parties. We also receive profile information from the social media platform(s) that you use to log in or create accounts with us, as per their terms and policies.

All the information provided to the Company by you, including Personally Identifiable Information or any Sensitive Personal Information, is voluntary. You understand that the Company may use certain information of yours as provided in Section 3 below.

This policy does not apply to, nor does the Company take any responsibility for any information that is collected by any third-party, either using the Website or through any third-party links made available to you during your use of the Website.

3. How We Use Information We Collect

We will use the information collected from you for the following purposes:

•  Ensuring the Services with respect to the Website is presented in the most effective manner for your use which includes providing RMP/partner provider(s) details about you to the extent necessary for their consultation/other services and as consented by you;

•  To improve and secure the Website: We are always looking for ways to make our Website smarter, faster, secure, integrated, and useful to you. We use collective learnings about how Users use the Website and feedback provided directly to us to troubleshoot and to identify trends, usage, activity patterns and areas for integration and improvement of the Website;

•  To provide you with information pertaining to the Services we offer, send newsletters and transactional communication and user support and Services that you request from us;

•  To carry out obligations arising from any contracts entered into between you and us, including for billing;

•  To notify you about any changes and improvements to the Website; or analytical purposes, including but not limited to assessing usage data, usage patterns, and other similar activities;

•  When you create a User Account, we keep a record of your communication to help solve any issues you might be facing;

•  In any other way that we may describe to you at the time you provide the information or to fulfill any purpose for which you provide the information;

•  We use information collected from cookies and other tracking technologies to improve the User experience;

•  To provide and process service requests initiated by you;

•  To validate, authorize and map a specific profile with an authorized User;

•  As with most consumer-facing businesses with an online presence, we do share a limited set of data that is gathered when you visit our App, such as cookies and pixels, with third parties in order to allow you to see tailored digital advertisements.

Except as otherwise provided herein, we will not disclose, publish, sell, rent, market, or share with any third-party your information without your express consent.

Please do not include or provide any Personally Identifiable Information or Sensitive Personal Information unless specifically requested as part of the registration or other applicable processes. Also, do not provide any information pertaining to another person if you are not authorized to provide such information on behalf of such other person. If you have provided or uploaded any information which violates the terms of this Privacy Policy, we may be required to delete such information upon informing you of the same and revoke your access if required without incurring any liability to you.

You also may provide information to be published or displayed or posted on the Website or transmitted to other users of the Website or third-parties. Any such information posted or transmitted to others shall be at your own risk. Please be aware that we cannot control the actions of other users of the Website with whom you may choose to share your information.

4. Information We Share and Disclose

We share information about you for the following operational reasons and for maintaining the Website:

For Services: We may share your information with RMPs, health coaches, wellness coaches, medical experts, counsellors, health practitioners, partner labs, partner vaccination providers, partner scan providers for the purposes of providing you Services.

For Customer Support: We use your information to resolve technical issues you encounter, to respond to your requests for assistance, to analyze crash information, and to repair and improve the Website.

For Legal Reasons: We will also share information with individuals or entities to the extent it believes in good faith it is required to:

•  ensure compliance with law/regulations and/or pursuant to enforceable orders of government, law enforcement or regulatory authorities;

•  address fraud, security or technical issues;

•  protect against harm to the rights, property or safety of us, its other users or the public as required or permitted by law.

For Effective Provision of the Website: We may share information provided by you with our employees, contractors, agents, and other representatives who need to know that information in order to provide Services to you and who are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to meet these obligations.

To conduct analysis: We are always looking for ways to make our Services secure, integrated, and useful to you. We use collective learnings about how people use our Services, and to identify trends, usage, activity patterns and areas for integration and improvement of the Services. We also test and analyze certain new features with some users before rolling the feature out to all users. We may also share aggregated information (information about our users that we combine so that it no longer identifies or references an individual user) and other pseudonymized information for regulatory compliance, industry and market analysis, demographic profiling, marketing and advertising, and other business purposes.

NavaMaa is not liable for the security of any data shared through WhatsApp. You are subject to and must comply with the terms of use and privacy policy of WhatsApp.

Our Website may contain links to or integrations with other services such as Facebook, Twitter, LinkedIn, and other media services and platforms whose information practices may be different than ours. Visitors should consult these other services’ privacy notices as we have no control over information that is submitted to, or collected by, these third parties.

We cannot ensure that all of your information shall never be disclosed in ways other than those described in this Privacy Policy. For example, but without limiting and foregoing, we may be forced to disclose your personal information to the government, law enforcement agencies or other third parties. Under certain circumstances, third parties may unlawfully intercept or access transmission or private communications, or abuse or misuse your personal information that they may collect from our website. Therefore, we do not promise, and you should not expect, that your personally identifiable information or private communications would always remain private.

5. How We Store and Protect Your Information

We store information on our databases and on servers in various countries around the world. We may store your information on a server located outside India.

The information that you provide, subject to disclosure in accordance with this Privacy Policy and other agreements (if any), shall be maintained in a safe and secure manner. Our databases and information are stored on secured servers.

We use industry standard and commercially reasonable physical, technical and administrative security measures to safeguard all information, and to ensure their confidentiality.

When you enter user information (such as log in credentials) in respect of your User Account or when you upload any information through the use of the Platform, we take reasonable efforts to ensure that your user information and all other information submitted by you is safe and secure; however, we make no representation, warranties or other assurances that the security measures are adequate, safe, foolproof or impenetrable.

Given the nature of internet transactions, we do not take any responsibility for the transmission of information including user information shared by you. Any transmission of user information on the internet is done at your risk and Company shall not be responsible for the circumvention of the privacy settings or security measures either by you or any third-party.

6. Your Requests

Data Retention and Data Deletion: We shall retain information that we collect for as long as is necessary for the performance of the contract between you and us and to comply with our legal obligations. If you no longer want to use the Platform and want your User Account or Information to be deleted, you may contact us on info@navamaa.com to request in good faith that your User Account or Information be deleted. Your User Account and all your Information will be deleted within a reasonable period of time, subject to applicable law. If you wish to use the Platform to avail any associated services therein once your User Account is deleted pursuant to your request, you will have to sign-up as a new User.

Rectification of Inaccurate or Incomplete Information: We may permit or deny modification of any information, to the extent such information is required by us in order to be compliant with applicable laws. You may request us in good faith to correct inaccurate or incomplete personal information concerning you (which you cannot update yourself within your account). However, please note that in the event you withdraw your consent, we cannot ensure the continuity of your access or usage of the Platform and any associated services.

Withdrawing Consent and Restriction of Collecting Data: Where you have provided your consent to the collection of your information by us, you may withdraw your consent at any time by sending a communication to us at info@navamaa.com specifying which consent you are withdrawing. Please note that the withdrawal of your consent does not affect the lawfulness of any processing activities based on such consent before its withdrawal. However, please note that in the event you withdraw your consent, we cannot ensure the continuity of your access or usage of the Platform and any associated services.

Complaints: If you wish to place a complaint with regard to privacy requirements or laws, access any of your information or would like to update or correct any errors in your user information, please contact our Grievance Redressal Officer, at info@navamaa.com so that we can consider and respond to your request. We will endeavour to address all request within 7 business days from the date such a request is made.

7. Personal Data of Others

In some situations, you may provide information of other individuals (family, friends, etc.) to us. If you provide us with such information, you represent and warrant that you have obtained their consent for their information to be collected, used and disclosed as set out in this Privacy Policy.

8. Restrictions

The Platform is only intended for users who are of eighteen (18) years of age or older. If you are not of the requisite age, you are not to provide any user information or other information. We shall have the right to revoke the access to the Platform and delete accounts of users below the age of eighteen (18) without notice.

9. Amendments

This Privacy Policy is subject to change from time to time. If we make changes to this Privacy Policy, we will post the revised Privacy Policy on the Platform and update the "Last Updated" date at the beginning of this Privacy Policy. If you disagree with the revised Privacy Policy, you may cancel your user account or stop your usage of the Platform and any Services. Your use of the Website will be deemed an acceptance of the privacy policy existing at that time.

10. Governing Law

This Privacy Policy is governed by and operated in accordance with the laws of India. If any of the parties wish to seek legal recourse, they may do so by using the courts of law in Bengaluru, India.

The following Terms of Use ("Terms") and the Privacy Policy govern your ("User", "you", "your") access, viewing, and use of the services available through the Platform (as defined below).

The Platform is owned and operated by NavaMaa Health and Wellness Private Limited (also referred to as "NavaMaa", "Company", "we", "our", "us"), a company incorporated under the laws of India and having its registered office at [NavaMaa Registered Address].

By accessing, downloading, or using the Platform, you agree to be bound by these Terms of Use and the Privacy Policy.

DEFINITIONS

"Platform" means the Website;

"Privacy Policy" means the privacy policy available at http://www.navamaa.com/support;

"Services" means the services provided by the Company through the Platform, including but not limited to consultations, facilitation of diagnostic services, vaccination services, health screening services, preventive health services, general advice, and provision of content;

"Website" means www.www.navamaa.com, accessible on a mobile phone, tablet or computing device;

"Users" means individuals who use the Platform, whether registered or not; and

"User Information" means any and all information provided by the User, including name, age, sex, address, email address and phone number, while signing up for the Platform or thereafter.

USE OF THE PLATFORM

Services are provided solely for the User's personal and non-commercial use and must not be shared with any third party. Given the sensitive and personalised nature of the Services, advice, prescriptions, and consultation records are intended exclusively for the User and must not be shared with others for their own medical purposes. You acknowledge that NavaMaa is not a substitute for emergency medical care.

You agree to use all Services in accordance with applicable laws, rules, and regulations. For assistance, please write to us at info@navamaa.com.

By providing information to the Company, you confirm your understanding and acceptance of the Privacy Policy.

To avail Services, you must be 18 years of age or older, or have attained the age of majority in your jurisdiction. Certain services, such as vaccination, may be availed for children, provided that the Registered Member for all patients under the age of 18 is the patient's parent or legal guardian, who shall be fully responsible for compliance with these Terms.

Users residing outside India may only access certain wellness services or attend webinars delivered virtually through third-party platforms including WhatsApp, Zoom, and Google Meet. Registered Medical Practitioners ("RMPs") listed on the Platform are licensed and registered to practise medicine in India under applicable Indian law, and consultations with RMPs are accordingly limited to users residing in India. Any medical prescription issued by an RMP is valid solely within Indian jurisdiction.

In connection with your use of and access to the Platform, its content and features, you agree and undertake not to:

•  Re-sell the usage of the Platform;

•  Upload, transmit or publish information on behalf of a third party, or impersonate any other person;

•  Upload, transmit or publish any material that is harmful, false, misleading, abusive, harassing, defamatory, obscene, pornographic, paedophilic, libellous, hateful, racially or ethnically objectionable, or otherwise unlawful in any manner;

•  Create User accounts by automated means or under false or fraudulent pretences;

•  Take any action that imposes an unreasonable or disproportionately large load on the Platform's IT infrastructure;

•  Use any robot, spider, site search or retrieval application, or similar device to retrieve or index any portion of the Platform;

•  Upload, transmit or publish any material that may harm minors in any way;

•  Violate or invade the privacy of any person or other Users;

•  Upload, transmit or publish viruses or other malware that may corrupt, interrupt, limit, destroy, or otherwise impact the Platform or any connected systems;

•  Upload, transmit or publish any material to which you do not hold the necessary rights, or that infringes the intellectual property rights of any third party;

•  Deceive or mislead other Users about the origin of your communications, or communicate content that is grossly offensive or menacing;

•  Access the Platform in any unauthorised manner, including by hacking or using another User's login credentials;

•  Use the Platform for unauthorised marketing purposes or for transmitting unsolicited materials or spam; or

•  Engage in any act that threatens the unity, integrity, defence, security or sovereignty of India, or friendly relations with foreign states, or that causes incitement to the commission of any cognisable offence.

Content published on the Platform is informational in nature and does not constitute medical advice without the express consultation of qualified professionals, whether those available through the Platform or otherwise duly qualified third-party professionals.

Professionals whose services are available through the Platform include RMPs, diagnostic service providers, vaccination providers, screening service providers, health instructors and wellness coaches. These professionals retain discretion in determining the appropriate mode of communication, in accordance with the clinical and operational protocols by which they are bound.

You agree and undertake that all information you provide regarding your health and medical condition is accurate, and you consent to such information forming part of your health records, diagnoses, prescriptions, or such other documents created during your consultation through the Platform.

You further agree to comply with the instructions of the RMPs, diagnostic service providers, vaccination providers, screening service providers, health instructors, and wellness coaches as applicable, including any health education, counselling, and prescriptions issued. Should you deviate from such instructions, neither the Company nor the relevant service provider shall be liable for any adverse consequences arising therefrom.

The Services are not designed or intended to address medical emergencies or circumstances requiring attendance at a hospital casualty or emergency department. You undertake that in the event of a medical emergency, you will not rely on NavaMaa's Services and will instead seek immediate medical attention at a nearby physical facility or from a locally available medical professional.

Your interaction with RMPs and other service providers is governed by applicable Indian law and the Company's contractual arrangements with such providers. The Company and the Platform facilitate interactions between Users and service providers, and the Services are subject to the limitations and disclaimers set out herein.

Services may be offered in asynchronous and synchronous formats, including real-time and store-and-forward consultation models. Any new modes of communication introduced in future shall also be governed by these Terms and the Company's internal policies.

By using the Platform, you consent to receiving calls, SMS messages, emails and other communications from the Company at the contact details you have provided. This includes booking confirmations, cancellations, rescheduling notifications, and other transactional communications via Email, SMS, WhatsApp, or voice call. You also consent to receiving communications even if your number is registered under the DND/NCPR list under TRAI regulations, and you authorise the Company to share your contact information with third-party service providers for this purpose. Communications from the Company shall not be deemed Unsolicited Commercial Communications under TRAI guidelines. The Company will use third-party platforms to send WhatsApp messages and SMS notifications.

REGISTRATION

Users must register on the Platform in order to avail the Services. The Company will seek further information and identification documentation from you in accordance with the Privacy Policy.

You agree not to create more than one User account, or to create a User account for any person other than yourself without first obtaining that person's permission. The Company may, at its sole discretion, decline to accept your registration for non-compliance with any applicable eligibility requirement.

You shall at all times be responsible for all activities undertaken through your User account.

You represent that you hold all rights necessary to provide the information you submit on the Platform, including User Information, and that such information is true and accurate.

All User Information shall be used and processed in accordance with these Terms and the Privacy Policy.

The Company engages third-party service providers, including courier services, for the fulfilment of orders placed on the Platform. Relevant information will be shared with such third parties as required.

BOOKING CONSULTATIONS, DIAGNOSTIC SERVICES, VACCINATION SERVICES AND OTHER HEALTH SERVICES

The Platform enables Users to connect with RMPs, diagnostic service providers, vaccination providers, screening service providers, health instructors, and wellness coaches through the following methods: (a) online appointment booking through the Platform; (b) WhatsApp messaging with a Company representative; or (c) calling us at +91 6362137879.

User Information collected through the Platform will be shared with relevant service providers for the purpose of appointment booking and service delivery.

The Company will endeavour to ensure that appointments are confirmed by the respective service providers. However, in the event an appointment is cancelled by the service provider, the Company shall bear no liability in respect thereof.

The Company is not involved in providing healthcare, medical advice, or diagnosis and is not responsible for interactions between Users and service providers. Liability for user interactions, quality of treatment, medical negligence, cancellations, rescheduling, and fee variations rests solely with the respective RMP or service provider.

NavaMaa reserves the right to deny service where circumstances outside its control prevent service delivery, particularly in locations outside Bengaluru, or where Users fail to comply with these Terms or engage in conduct in contravention of this policy.

In order to use NavaMaa's services, whether online or at our clinics, Users must:

•  Treat all RMPs, diagnostic service providers, vaccination providers, screening service providers, health instructors, wellness coaches, NavaMaa staff, other patients and visitors with courtesy and respect. Any verbal or physical harassment or violence will result in immediate termination of services and may result in further action under applicable law.

•  Attend appointments on time and, where rescheduling or cancellation is necessary, provide as much advance notice as possible in compliance with the applicable cancellation and rescheduling policy.

•  When visiting our clinics: abide by all clinic rules and regulations; comply with the no-smoking policy; be considerate of noise levels, privacy and safety; and note that weapons of any kind are strictly prohibited on the premises.

•  Pay for services in a timely manner in accordance with applicable clinic policies.

•  Respect that another patient's medical condition may be more urgent and accept that RMPs and clinic staff may be required to attend to them first.

DIAGNOSTIC SERVICES AND OTHER AT-HOME SERVICES INCLUDING DELIVERY OF INTIMATE PRODUCTS

The Company assists Users to book appointments with partner diagnostic centres, laboratories, radiology and screening service providers for the purpose of conducting tests as required by Users pursuant to health check-ups or as recommended by medical practitioners. Reports generated by diagnostic centres are provided to the Company and in turn to the User.

Information collected for the facilitation of diagnostic services includes: name; age; prescription (if applicable); test details; medical history (if applicable); email address; residential address; phone number; and financial information.

Users agree to provide the above information for the purposes stated herein. Users acknowledge that the Company will have access to their details as well as reports and records generated by the diagnostic service provider.

Where available, Users may opt for home collection of samples. Home collection is conducted by the technicians of the relevant diagnostic service provider in accordance with their internal procedures and policies.

The diagnostic service provider is solely liable for user interactions, the fulfilment of obligations to Users, cancellations, rescheduling, and fee variations. The Company is a facilitator only and has no control over the procedures of the diagnostic service provider. The diagnostic service provider is solely responsible for the actual test, analysis and diagnosis contained in the report. To the fullest extent permitted by applicable law, the Company disclaims all representations, warranties and liability with respect to the information and diagnosis contained in any report generated by a diagnostic service provider.

Invoices for diagnostic services are provided at the time of booking and payment must be made online at that time. Complaints regarding the booking facility may be reported to info@navamaa.com.

Cancellations and Refunds — Diagnostic and At-Home Services

•  All bookings are non-cancellable once payment has been made. All bookings are non-refundable except in cases of non-performance of services by NavaMaa or its diagnostic service providers.

•  Home collection slots are subject to availability. In the event of non-availability of the chosen slot, lockdowns, adverse weather conditions, or other unforeseen circumstances, the slot may be changed and NavaMaa will notify the customer. NavaMaa will offer alternate slots closest to the originally booked date. NavaMaa is not liable to provide a refund where the original slot is unavailable.

•  Rescheduling once a booking has been confirmed by NavaMaa may attract an additional charge of up to INR 250. Requests to reschedule must be communicated to NavaMaa at least 2 hours prior to the chosen slot.

•  No-Show Policy: A customer not physically present at the address provided for at-home services during the chosen slot shall be considered a no-show. No refunds shall be processed in case of no-shows. NavaMaa will attempt to reschedule subject to availability; a charge of up to INR 250 may apply.

•  Intimate and physical products are non-returnable, non-exchangeable and non-refundable once an order has been placed.

•  Delivery and Shipping: All orders are dispatched from third-party warehouses located in Bangalore. NavaMaa aims to deliver orders within 1 to 15 days from receipt of order and successful payment processing. Deliveries are facilitated by third-party courier and logistics companies.

VACCINATION SERVICES

The Company assists Users to access vaccination services through partner vaccination providers as required pursuant to health check-ups or as recommended by medical practitioners.

Information collected for the facilitation of vaccination services includes: name; age; prescription (if applicable); vaccination details; medical history; email address; residential address; phone number; and financial information.

Where available, Users may opt for home administration of vaccination services. Home vaccination is conducted by the technicians or registered nurses of the relevant vaccination service provider in accordance with their internal procedures and policies.

The vaccination service provider is solely liable for user interactions, the procurement, storage, delivery and administration of vaccines, cancellations, rescheduling, and fee variations. In the event of cancellation by the vaccination service provider, NavaMaa will endeavour to provide prior notice and will reschedule the appointment or refund the payment made at the time of booking, as appropriate. If no notification has been sent, Users may contact info@navamaa.com.

Cancellations and Refunds — Vaccination Services

•  All bookings are non-cancellable and non-refundable once payment has been made, except in cases of non-performance by NavaMaa or its vaccination service providers.

•  Home vaccination slots are subject to availability. In the event of non-availability, lockdowns, adverse weather or other unforeseen circumstances, the slot may change and NavaMaa will notify the customer. NavaMaa will offer alternate slots closest to the originally booked date.

•  Rescheduling once confirmed may attract an additional charge of up to INR 250. Requests to reschedule must be communicated at least 2 hours prior to the chosen slot.

•  No-Show Policy: A customer not physically present at the address provided for at-home vaccination during the chosen slot shall be considered a no-show. No refunds shall be processed. NavaMaa will attempt to reschedule subject to availability; a charge of up to INR 250 may apply.

BUNDLED SERVICES — WELLNESS PROGRAMS, PACKAGES, VOUCHERS AND GAMEPLANS

Users may sign up for bundled services, including but not limited to bundled teleconsultations, wellness sessions, diagnostics, vaccinations, and screening services, offered in the form of programs, packages, vouchers or gameplans facilitated by the Platform.

The Company facilitates participation in such services only. Advice and diagnosis provided by RMPs, health instructors, wellness coaches and subject-matter experts are based solely on the information provided by the User and the expertise of the relevant professional. The Company is not involved in providing healthcare, medical advice or diagnosis and disclaims all liability with respect to information, advice and diagnosis provided through such bundled services. Diagnostic, vaccination, screening and other services forming part of a bundled offering are governed by the terms applicable to those individual services.

Utilised services shall be priced at their full individual price rather than any applicable discounted package price.

•  Refunds and partial refunds may take up to 10 business days to process.

•  In the event of cancellation of a program or unavailability of the relevant professional, NavaMaa will endeavour to provide prior notice and will reschedule or refund as appropriate. Users may contact NavaMaa if no notification has been received.

THIRD PARTY INTERACTIONS

The Website may from time to time contain links to or host content or resources provided by third parties, made available solely for the User's information and convenience. NavaMaa makes no representations or warranties regarding the content, suitability or appropriateness of such third-party websites or resources and encourages Users to review the privacy and terms policies of any third party with whom they interact.

AVAILMENT OF EMI OPTIONS

Customers who pay through a third-party EMI provider (including but not limited to Simpl, Axio, or a bank) remain liable for consequent payments as raised by the relevant lender. NavaMaa is not responsible where a customer chooses to discontinue Services after having availed an EMI facility.

In the event of a plan cancellation for a purchase made via EMI, NavaMaa will facilitate refunds (if applicable) in accordance with the relevant refund policy. Customers are advised to consult their bank or issuer regarding the effect of any cancellation or refund on their EMI terms, and any pre-closure or interest charges that may be levied.

The EMI facility is offered solely by the respective bank or lender at their discretion. NavaMaa has no role in the approval, extension, pricing, modification, pre-closure, closure or any incidental matter relating to the EMI facility.

NavaMaa shall not be liable for any dispute arising out of or in connection with an EMI facility offered by a bank or lender.

CANCELLATION, NO-SHOW, RESCHEDULE AND REFUND POLICY

Teleconsultations and Wellness or Health Coaching Sessions

Cancellations: Cancellations made at least 2 hours (120 minutes) prior to the scheduled start time will receive a 100% refund. No refunds shall be provided for cancellations made within 2 hours of the scheduled start time. Refunds may take up to 10 business days to process.

Rescheduling:

•  For physiotherapy appointments: One (1) free reschedule is permitted up to 1 hour (60 minutes) before the scheduled start time. No further rescheduling shall be accommodated thereafter. Customers who cannot attend may book a new appointment at full price.

•  For all other appointments: One (1) free reschedule is permitted. No further rescheduling shall be accommodated thereafter. Customers who cannot attend may book a new appointment at full price.

Customer No-Show Policy: A customer who fails to join the teleconsult within 10 minutes of the scheduled start time shall be considered a no-show. No refunds shall be processed in case of no-shows. NavaMaa shall not be liable and shall not provide a refund, free reschedule or extended appointment duration.

Late Joining: A customer may join up to 10 minutes after the scheduled start time, after which the appointment time shall be reduced to the remainder of the booked slot. Failure to join within 10 minutes shall result in the customer being marked as a no-show and the teleconsult ending. No refund, free reschedule or extended duration shall be provided.

Free Consultations and Follow-ups: One (1) free follow-up per teleconsult may be booked within 7 days of the appointment date, depending on the type of consult. If no slots are available within 7 days, customers may contact NavaMaa via call or WhatsApp to request an extension or a different doctor, subject to availability. Program, voucher, gameplan and package participants do not qualify for free follow-ups as their programs follow a fixed structure with a defined number of appointments. Consults provided as follow-ups to a diagnostics or lab test booking, or as part of a package booking, are not eligible for an additional free follow-up unless otherwise specified. If cancellation of a follow-up is unavoidable, patients are requested to cancel at least 2 hours prior to the consultation time. One (1) free reschedule is permitted up to 2 hours prior to the follow-up consultation time. Post-cancellation or after exhausting the first reschedule, a new appointment must be booked and paid for.

•  Cancellation requests on medical grounds will be considered on a case-by-case basis at NavaMaa's sole discretion. Where a partial refund is approved, a 10% admin/cancellation fee shall be deducted.

•  For bundled purchases or multiple items, partial cancellation requests will be considered on a case-by-case basis. Where a partial refund is approved, a 10% admin/cancellation fee shall be deducted and utilised services shall be priced at their full individual price.

•  Refunds may take up to 10 business days to process.

Rescheduling: Rescheduling once confirmed may attract a charge of up to INR 250. Requests must be communicated at least 2 hours prior to the chosen slot.

•  Cancellation requests on medical or other grounds will be considered on a case-by-case basis at NavaMaa's sole discretion. Where a partial refund is approved, it shall be calculated on a pro-rata basis after deducting fees for partial usage and an additional 10% admin/cancellation fee. Utilised services shall be priced at full individual price.

•  Refunds may take up to 10 business days to process.

•  Rescheduling of bundled services is subject to availability of relevant experts and appointment slots. NavaMaa shall not be liable to provide a refund where rescheduling cannot be accommodated.

•  NavaMaa shall not be liable to provide a refund, free reschedule or extended session duration for sessions missed or not attended by the User.

Services at NavaMaa Clinics

Consultations:

•  Cancellations: Cancellations made at least 2 hours (120 minutes) prior to the consultation time will receive a 100% refund. No refunds shall be provided for cancellations made within 2 hours. Refunds may take up to 10 business days to process.

If cancellation of a follow-up is unavoidable, patients must cancel at least 2 hours prior. Post-cancellation, a new appointment must be booked and paid for.

Lab Tests, Vaccinations and Other Clinic Services:

•  All bookings are non-cancellable and non-refundable once payment has been made, except in cases of non-performance by NavaMaa or its service partners.

•  Medical ground cancellation requests will be considered on a case-by-case basis with a 10% admin/cancellation fee deductible. Bundled or multiple-item partial cancellation requests shall be handled on the same basis. Refunds may take up to 10 business days.

No-Show and Late Arrival at Clinics: A customer failing to reach the clinic within 10 minutes of the scheduled appointment start time shall be considered a no-show. No refunds shall be processed. Late arrivals within 10 minutes will receive the remainder of the booked slot only. Arrivals more than 10 minutes late shall be treated as no-shows and any service will be subject to slot availability at NavaMaa's sole discretion.

To the maximum extent permitted by law, NavaMaa shall not be liable in any way for any loss or damage suffered by you through use of or access to the Platform, or arising from NavaMaa's failure to provide the Platform. While NavaMaa takes all reasonable care to ensure the availability of the Platform, the Platform may at times be unavailable due to maintenance, technical issues, or circumstances beyond NavaMaa's control. NavaMaa does not warrant uninterrupted access to the Platform and has no obligation to notify Users of unavailability. NavaMaa's liability for negligence, breach of contract or contravention of any law arising from failure to provide the Platform or any part thereof is limited, at NavaMaa's option and to the maximum extent permitted by law, to resupply of the affected Services or INR 10,000.

Content, data, graphics, blogs, webinars and other material provided on the Platform by subject-matter experts, healthcare instructors or medical professionals are provided on an "as is" basis for informational purposes only. Such content does not create a doctor-patient relationship between the Platform and the User and does not constitute medical advice, diagnosis or treatment. NavaMaa makes no representations or warranties, whether express or implied, regarding the professional qualifications, quality of work or expertise of any person whose content is featured on the Platform. NavaMaa shall not be liable for any decision made or action taken in reliance on such information.

NavaMaa is not involved in providing healthcare, medical advice or diagnosis and is not responsible for interactions between Users and RMPs or service providers. NavaMaa shall not be liable for: your interactions with service providers; the ability or intent of service providers to fulfil their obligations; medication prescribed or quality of treatment; medical negligence; inappropriate treatment; cancellation or unavailability of service providers; or misconduct by service providers or their staff.

Your engagement with any RMP or service provider does not create a medical professional-patient relationship between you and NavaMaa, nor does it constitute an opinion, medical advice, diagnosis or treatment. Prescriptions issued by RMPs are generated solely on the basis of the RMP's expertise and the information provided by the User, whether through teleconsultation or in-person clinic visits. The RMP alone is liable for and responsible towards the diagnosis conducted and the advice contained in any prescription. NavaMaa disclaims all warranties in that regard.

Diagnostic, vaccination, screening and other health services provided at your home or at a provided address are delivered by third-party service providers. NavaMaa is a facilitator only and any smart report generated by NavaMaa as an attachment to test results is not a substitute for medical advice from a qualified doctor. The third-party service provider is solely liable for the actual test, analysis and diagnosis contained in the report. NavaMaa disclaims all warranties with respect to the information and diagnosis contained in any lab or health report.

Except as otherwise expressly provided, all content and information on the Platform is provided on an "as is" basis without warranty of any kind, whether express or implied.

NavaMaa collects and displays information regarding the profile and practice of RMPs and other health experts listed on the Platform, including specialisation, qualification, experience, fees, location and visiting hours. While NavaMaa takes reasonable steps to ensure accuracy, it cannot be held liable for any inaccuracies or omissions in such information. NavaMaa makes no representations or warranties, whether express or implied, regarding the professional qualifications, quality of work or expertise of any listed RMP or expert.

IN NO EVENT SHALL NAVAMAA BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DECISION MADE OR ACTION TAKEN BY YOU IN RELIANCE ON SUCH INFORMATION.

SUSPENSION AND TERMINATION

NavaMaa reserves the right to immediately suspend access to the Platform if it suspects any violation of these Terms or any applicable laws and regulations. NavaMaa shall have the right to retain and use data related to the Platform.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of India. The courts of Bengaluru shall have exclusive jurisdiction over any dispute arising out of your use of the Services, without regard to any conflict of law provisions.

Subject to the type of consultation booked, one (1) complimentary follow-up per teleconsult may be scheduled within 7 days of the original appointment. In the event of non-availability of the chosen slot, lockdowns, pandemic or epidemic restrictions, adverse weather, or other unforeseen circumstances, the slot may be amended. NavaMaa will notify the customer and offer the nearest available alternate slot. NavaMaa shall not be liable to provide a refund solely on account of slot non-availability.

•  Cancellation requests on medical grounds shall be considered on a case-by-case basis at NavaMaa's sole discretion. Where a partial refund is approved, a 10% admin/cancellation fee shall be deducted.

•  For bundled or multiple-item purchases, partial cancellation requests shall be considered on a case-by-case basis at NavaMaa's sole discretion. Where a partial refund is approved, a 10% admin/cancellation fee shall be deducted. This section applies to any bundled services, including but not limited to bundled teleconsultations, lab tests, vaccinations and related services, offered in the form of a program, package, voucher or gameplan, whether availed at home or at NavaMaa clinics.

•  Where a customer seeks to cancel on medical or other grounds after partial use of a program, package, voucher or gameplan, such requests shall be considered on a case-by-case basis at NavaMaa's sole discretion. Where a partial refund is approved, it shall be calculated on a pro-rata basis after deducting fees for partial usage and an additional 10% admin/cancellation fee. Utilized services shall be priced at their full individual rate rather than any applicable discounted package price.

•  All bookings are non-cancellable and non-refundable once payment has been made, except in cases of non-performance by NavaMaa or its chosen laboratory or vaccination partners.

•  A cancellation requested 24 hours or more before the scheduled appointment shall be eligible for a 100% refund. No refund for cancellations within 24 hours.

•  Cancellation requests on medical grounds shall be considered on a case-by-case basis at NavaMaa's sole discretion, with a 10% admin/cancellation fee deductible from any approved refund.

•  For bundled or multiple-item purchases, partial cancellation requests shall be considered on a case-by-case basis with a 10% admin/cancellation fee deductible. Utilized services shall be priced at their full individual rate.

•  Refunds and partial refunds may take up to 10 business days to process.

No-Show and Late Arrival — In-Clinic

A customer who fails to reach the clinic within 10 minutes of the scheduled appointment start time shall be deemed a no-show. No refund shall be processed. NavaMaa shall not be liable and shall not provide a refund, complimentary reschedule or extended appointment duration.

A patient who arrives within 10 minutes of the scheduled start time shall receive the remainder of the booked slot only, with no additional time, refund or reschedule provided. A patient arriving more than 10 minutes late shall be deemed a no-show; any further service shall be subject to slot availability at NavaMaa's sole discretion.
